Your employer must:
- Employer needs to have a business currently based in Alberta, and they must be registered and incorporated in Canada
- The job being offered needs to meet the provincial wage and employment standards
- No collective bargaining agreements should be in conflict with this proposed employment
- A positive LMIA must be received for the job position being offered unless it is exempt
- A valid settlement and retention plan must be supplied for the employee
Your employer must:
- be established as an employer in good standing in B.C.
- provide full-time, indeterminate (permanent or with no set end date) employment
- have a history of good workplace and business practices
- sign an employer declaration
- meet domestic labour market recruitment requirements, where applicable
- make you a full-time, indeterminate job offer
- offer you a wage in line with industry standards
As well as meeting the general employer requirements, your employer must:
- give you a written job offer
- complete the employer sections of the application forms
- notify the BC PNP if there are any changes in your employment status. This includes a promotion or termination; if you have been laid off or are on extended leave; or if the business has closed or changed ownership.
The BC PNP will not approve applications from:
- employers involved in producing, distributing or selling pornographic or sexually explicit products, or providing sexually oriented entertainment or services
- employment agencies and similar firms, unless they are establishing an employer/employee relationship with the registrant and/or applicant
- any other type of business that by association would tend to bring the BC PNP or the Government of British Columbia into disrepute.
Your employer must:
- be registered as a corporation, limited partnership or sole proprietorship
- be established in Manitoba for a minimum of three years
- be a commercial business and not a home-based business
- have a minimum of $250,000 in revenue in the immediate three years preceding the application
- not currently be on the Employment and Social Development Canada/Service Canada suspension list
- not have been assessed a fine for breaking the rules of the Temporary Foreign Worker Program (TFWP) or the International Mobility Program (IMP)
- have an established employer–employee relationship and the employee cannot be in a partnership or proprietor relationship with the employer (e.g. owner-operator in trucking industry or partnership in a restaurant)
- not be working with employment agencies using temporary workers
- not be seeking to sell their business or portions of their business in the next two years
- have a positive history with Employment Standards (no systemic history of non-compliance) and the Manitoba Provincial Nominee Program, if applicable
Your employer must:
- be permanently established in Newfoundland and Labrador, as defined by the federal Income Tax Act.
- have operated in Newfoundland and Labrador, under current management, for at least two (2) consecutive years.
- If the business is located within the St. John’s census metropolitan area, then the employer must have at least two (2) permanent, full-time local employees in the staff complement.
- If the business is located outside of the St. John’s census metropolitan area, then the employer must have at least one (1) permanent full-time local employee in the staff implement.
- The employer must provide a full-time job offer for at least two years (with the possibility of extension) for employment located in Newfoundland and Labrador, in an occupation which falls under one of the five skills levels as per the National Occupational Classification (NOC) system.
- The job offer must meet Newfoundland and Labrador’s employment and wage standards.
- The employer must demonstrate that sufficient recruitment efforts have been made to hire Canadian citizens or permanent residents before offering the vacant position to the foreign worker.
- The employer must provide proof of authorization to hire a foreign worker by showing either the Labour Market Impact Assessment (LMIA), evidence of the LMIA exemption, or results of the approved Job Vacancy Assessment (JVA).
Employers should note the following:
- The employer must demonstrate that they have been unable to find a Canadian citizen or permanent resident of Canada to perform the job duties.
- The job must provide a comparable industry rate of pay. Accommodations provided by the employer will not be considered as part of the compensation package.
- The job complies with New Brunswick employment standards.
Some of the requirement for Employer are:
- The business has a permanent establishment in Nova Scotia;
- The business must have been in operation in Nova Scotia, under current management, for at least two years;
- The employer must have a history of good workplace and business practices;
- The employer must be compliant with all applicable laws and regulations;
- The employer must make a full-time, permanent job offer to the candidate. The job must:
- Be NOC Skill Type 0, Skill Level A or B;
- Be located in Nova Scotia;
- Have a compensation package that meets provincial employment standards and prevailing wage rates;
- Be a position for which there is a shortage of qualified permanent residents or Canadian citizens to fill the position; and,
- Not contravene any existing bargaining unit agreements, labour agreements/standards or be in any employment disputes;
- The employer must demonstrate satisfactory recruitment efforts to fill the position with a Canadian citizen or permanent resident.
The Employer must:
- Have a job vacancy;
- Identify a potential nominee;
- Be a registered business, industry association or a local, municipal, First Nation or Territorial government in the NWT that has been registered and operational for a minimum of one year;
- Be in good standing with the Worker’s Safety and Compensation Commission (WSCC) and the NWT Employment Standards Office;
- Provide proof of local and national recruitment efforts and submit a summary of results;
- Obtain a positive HRSDC Service Canada Labour Market Opinion.
To qualify under this stream, employer must have:
- have been in active business for at least three years prior to submitting your application
- have business premises in Ontario where you will work
- have no outstanding orders made against them under the Ontario Employment Standards Act, 2000 or the Occupational Health and Safety Act
- demonstrate that enough effort was made to recruit a Canadian citizen or a permanent resident prior to offering the position to you (this only applies if you are currently living outside Canada or working outside of Ontario)
- a minimum of $1,000,000 in total gross annual revenue if you will work or report to work at a location in the Greater Toronto Area (City of Toronto, Durham, Halton, York and Peel regions) or
- a minimum of $500,000 in total gross annual revenue if you will work or report to work at a location outside the Greater Toronto Area
- at least five full-time employees who are Canadian citizens or permanent residents who work at the location where you will work, or will report to work, if you will work or report to work at a location in the Greater Toronto Area (City of Toronto, Durham, Halton, York and Peel regions)
- at least three full-time employees who are Canadian citizens or permanent residents who work at the location where you will work, or will report to work, if you will work or report to work at a location outside the Greater Toronto Area
- Your employer must make an application for approval of an employment position by filling out and signing an Employer Form.Your employer then must give you the form so you can scan and upload it with your application.
